Application of the classifier and its meaning

Every landowner knows for what purposes he can use his land. That is, the intended purpose of land is determined a priori, until the moment of their acquisition. The use of lands is carried out on the basis of their purpose, but this is not enough.

In addition to the destination, which defines only the general context, the use of the site, private definitions are being viewed that limit the land user to narrower limits.

In order to normalize the regulation of land use and limit creative freedom, a classifier of types of permitted use has been created. Its necessity is dictated by the fact that general definition appointment is not enough.

Without strict restrictions, citizens and construction organizations, will violate the general background of the areas with arbitrary buildings, and in some cases may violate the established sanitary and seismological standards, for example, when buildings are erected in inappropriate places.

The classifier is the standard regulatory use land plot. For example, land for individual housing construction involves the construction of a house. But the houses are very different from each other. If this is a plot in a cottage settlement, naturally, only a cottage can be built on it.

And if this is a summer cottage (see), on which only country houses are provided, then additional permission is needed to build a cottage. In order to keep a reliable record of the permitted use of land in cadastral records, they are classified in accordance with a special list, where options are presented.

Each permission class is identified by a corresponding cipher or code.

And vice versa - each code corresponds to a set of permissions for use.

The main differences between the new and the old

The new classifier was adopted in the previous year and entered into force on December 24, 2014. It is based on the Decree of the Ministry of Economic Development of the Russian Federation of 09/01/2014. The classifier is given as an annex to the designated document and contains a list of types of permitted use, based on the following qualities of land: name, description and code.

The names are classified according to the likeness of several interconnected uses. They are given in the list in parentheses, as if emphasizing their unity and the possibility of application in the range of general permission that applies to the entire species presented in this paragraph.

For example, item 1 is presented in the classifier, permission to maintain Agriculture, in turn, it is subdivided into 18 subparagraphs. Each of the names of the sub-item has its own numerical value.

The description is general information about the characteristics of the permitted use, in order to avoid interpretations and interpretations, in order to expand the semantic framework. The description gives numerical characteristics of the properties of land plots related to the designated type, as well as notes.

The same paragraph states that on the lands of this type it is allowed to erect buildings used for the storage and processing of agricultural products.

The codes are indicated by a group of numbers that corresponds to the differentiated species designation. Accordingly, with respect to the first point, they are defined by numbers 1.1 - 1.18. In total, 12 destinations are allocated here, each of which is divided into types of permitted use.

Prior to the entry into force of this type of classifier, there was a so-called old classifier. The main difference in them is essential, that is, they were controlled by different legal sources. The old classifier relied on locally developed Development and Land Use Rules. The basis for its application is still the principles of zoning territories.

That is, the land mass, which is under the jurisdiction of a business entity, is divided into territorial zones. Each zone provided for limited uses of land located on the same land mass (in the zone). The uses fit appropriately into the purpose, and the purpose into the category.

Particular attention was paid to the urban context, where, in accordance with the classifier, were determined (and are being determined) built-up areas:

  1. residential areas;
  2. shopping centers;
  3. Cultural, entertainment and sports complexes;
  4. Zones cultural heritage protected by the state.

Before the introduction of the new classifier, construction was regulated municipal government architecture and urban planning, no buildings could be erected arbitrarily, at the whim of developers or investors.

The new classifier is aimed at strengthening control in this direction, and also suggests an advantage in the efficiency of accounting work.

AT this moment ratios of classifiers are produced, and the transition to new forms of accounting and control is being carried out, in the mode of optimizing the land use and management system.

For landowners and land users, who are ordinary citizens, this transition should not cause any particular inconvenience, work with the needs of the population should be organized in the regions in an appropriate way, with advice and support, upon request.

In addition to the subject content of the types of permitted use that are indicated in the classifier, there are its varieties presented in the list:

These nuances just play a significant role for landowners, since each type of use creates either a rigid binding to the classifier, or leaves it to the owner of the site, the possibility of a creative approach to its use. Next, we will look at some of the groups.

Main types

They define the regulations for permitted use in strict accordance with the urban context and other requirements for land use. Referring to an existing classifier, they will be determined by the full cipher or code.

For example, for the first item - farming, it will be indicated by sub-item numbers from 1 to 18, which will be placed after the item code. In the remaining 12 points - similarly.

In reality, it will look like that the owner of the land plot must strictly comply with the resolutive resolutions of the business entity, which are defined for nearby lands. His personal opinion this case will not play any role, he will not be allowed to carry out work on his own site that is not regulated for the surrounding context.

The owner must fit into the given program without violating it. But do not worry about this, since the rights of the owner are his inalienable constitutional rights that involve compromise between the two parties.

On their own they cannot legal force. They are used as supplements to the main or conditionally permitted uses. The need for their use arose when some nuances were needed to complement the permitted use.

Suppose, on agricultural land, allowed for pastures and remote from the place of residence, the owner decided to build a house for himself. He could not obtain a permit for this construction, since the lands have unique water meadows, and changing the main type of use to an arbitrary use of this category of lands is not allowed according to the standards.

However, understanding the situation of the owner, the municipality has the right to give subsidiary permission for the construction of a seasonal house, of a certain size, not intended for permanent residence. This type of authorization will not change the regulation of the type of use, but will enhance its effectiveness.

That is, digital codification is applied exclusively to the types of permitted use, due to the need to group them, and also because of their large number and to avoid confusion.

Conditionally allowed- Wider use of land is envisaged. In reality, this is a free building on the site that does not violate general form but with room for creativity. In this case, the owner submits the project to the appropriate authority and, if he receives permission, may make some changes.

Additional- this kind of actually has no legal force. But in some cases this practice is applied. For example: a person breeds livestock, and pastures are far from his place of residence. When contacting government bodies with a request for permission to build a house on the land, he will be refused, as the land is agricultural. The local municipality, having entered the position of the owner, gives consent - an auxiliary permit for temporary construction.

Land classification

Change in the type of permitted use of land

In some cases, it is required to change the type of permitted use of the land plot:

  1. during construction or reconstruction on a plot of real estate that has a different functional purpose than that specified in the VRI;
  2. changing the functions of an existing object;
  3. to clarify the VRI incorrectly entered or when bringing it into line with the new classifier.

At the moment, two important questions remain unanswered regarding the establishment and modification of the VRI:

1. What permitted uses of land plots should be chosen from the PZZ or from the Classifier, before the adoption of changes (before January 1, 2020)?

  • permitted use established before the adoption of the new Classifier (March 1, 2015) - whether it is considered valid, even if it does not correspond to the new VRI;
  • the owner of the land plot has the right to apply for the establishment or change of the VRI to the authorized body, within 1 month the request will be considered and the permitted use will be brought into line with the Classifier.

2. Existing procedures for changing the VRI, to which the actions of the GR (urban planning regulations) do not apply and are not established?

As practice shows, this is possible, although it is absolutely not provided for by law. A major role in this is played by the region and the practice that has developed in it on these issues.

Misuse of land and sanctions

The use of land for other purposes may be detected by regulatory authorities and will lead to administrative responsibility according to article 8.8. Code of Administrative Offenses of the Russian Federation.

Inappropriate purpose- the use of a land plot not provided for by its category, failure to fulfill obligations for its conservation and reclamation.

It entails the imposition of a fine on an individual from 20-50 thousand rubles, on an official from 100-200 thousand rubles, on a legal entity from 200-400 thousand rubles.

If the categories of permitted use of land plots provide only a general list of differentiation of allotments, then the types determine the list of types of permitted use of land plots, according to which it is permissible to specifically use agricultural land, settlements and others for their intended purpose, according to the classifier.

Differences between the new and old classifier

Until 2014, the indicated differentiation was carried out on the basis of the old classifier for the purpose of land plots adopted federal law dated July 22, 2010, under No. 167-FZ.
