Requirements

I. General provisions

1. These requirements establish mandatory organizational, engineering, technical, legal and other measures to ensure the anti-terrorist protection of facilities (territories) of the Ministry of Education and Science of the Russian Federation and facilities (territories) related to the scope of the Ministry of Education and Science of the Russian Federation (hereinafter - object (territory).

2. For the purposes of these requirements, objects (territories) are understood as complexes of technologically and technically interconnected buildings (structures, structures) and systems that have a common adjacent territory and (or) external boundaries, separate buildings (structures, structures), separate premises or groups of premises owned by the Ministry of Education and Science of the Russian Federation, the Federal Service for Supervision of Education and Science, the Federal Agency for Youth Affairs, organizations subordinate to the Ministry of Education and Science of the Russian Federation, the Federal Service for Supervision of Education and Science and Federal Agency for youth affairs executive power subjects of the Russian Federation and bodies local government exercising powers in the field of education and scientific activity, organizations under the jurisdiction of the executive authorities of the constituent entities of the Russian Federation and local governments exercising powers in the field of education and scientific activity, and other organizations operating in the field of education and science (hereinafter referred to as the bodies (organizations) that are the copyright holders of objects (territories )).

3. These requirements do not apply:

a) to objects (territories) subject to mandatory protection by troops national guard Russian Federation;

b) important state facilities, special cargo, facilities on communications subject to protection by the troops of the National Guard of the Russian Federation, in terms of their equipment with engineering and technical means of protection, the procedure for monitoring the equipment and operation of these engineering and technical means;


c) to objects (territories), the requirements for anti-terrorist protection of which are approved by other acts of the Government of the Russian Federation.

4. Responsibility for ensuring the anti-terrorist protection of objects (territories) rests with the heads of bodies (organizations) that are the copyright holders of objects (territories), as well as officials who directly manage the activities of employees at facilities (territories).

5. In order to establish differentiated requirements for ensuring the anti-terrorist protection of objects (territories), taking into account the potential danger and the degree of threat of a terrorist act at objects (territories), the significance of objects (territories) for infrastructure and life support and the possible consequences of a terrorist act, objects are categorized ( territories).

Categorization is carried out in relation to functioning (operated) objects (territories) when objects (territories) are put into operation, as well as in case of changes in the characteristics of objects (territories) that may affect the change in the previously assigned category.

6. The degree of threat of a terrorist act at an object (territory) is determined on the basis of data on the situation in the area where the object (territory) is located, on possible threats of a terrorist act, as well as on the basis of quantitative indicators of statistical data (information) on committed and prevented over the past 12 months of terrorist acts on the territory of a subject of the Russian Federation (with the exception of knowingly false reports about the threat of committing and (or) committing a terrorist act), on which the object (territory) is located.

Possible consequences of a terrorist act at an object (territory) are determined on the basis of forecast indicators on the number of people who may die or be harmed, and possible material damage, the forecast indicator of which is taken equal to the book value of the object (territory).

7. To carry out the categorization of an object (territory), by decision of the head of the body (organization) that is the owner of the object (territory), a commission is created to survey and categorize the object (territory) (hereinafter referred to as the commission):

a) in relation to a functioning (operated) facility (territory) - within 3 months from the date of approval of these requirements;

b) upon commissioning of a new facility (territory) - within 30 days from the date of completion of the measures for its commissioning.

8. The period of work of the commission is determined by the head of the body (organization) that appointed the commission, which is the owner of the object (territory), depending on the complexity of the object (territory) and is no more than 30 working days.

9. The commission includes representatives of the body (organization) that is the owner of the object (territory), employees of the object (territory), as well as representatives territorial authority security, territorial authority Federal Service troops of the National Guard of the Russian Federation or a unit of private security forces of the National Guard of the Russian Federation, a territorial body of the Ministry of the Russian Federation for civil defense, emergencies and aftermath natural Disasters at the location of the object (territory) (as agreed).

Experts from among the employees of specialized organizations that have the right to carry out an examination of the safety of objects (territories) may be involved in the work of the commission.

The commission is headed by an official who directly manages the activities of employees at the facility (territory).

10. In the course of its work, the commission:

a) conducts a survey of the object (territory) for the state of its anti-terrorist protection;

b) studies constructive and specifications object (territory), organization of its functioning, current measures to ensure the safe functioning of the object (territory);

c) determines the degree of threat of committing a terrorist act at the facility (territory) and the possible consequences of its commission;

d) identifies potentially dangerous areas of the facility (territory), the commission of a terrorist act on which may lead to emergencies with dangerous socio-economic consequences, and (or) vulnerabilities and critical elements of an object (territory), the commission of a terrorist act on which may lead to the cessation of the operation of the object (territory) as a whole, its damage or an accident on it;

f) determines the necessary measures to ensure the anti-terrorist protection of the object (territory), taking into account the category of the object (territory), as well as the timing of the implementation of these measures, taking into account the volume of planned work and funding sources.

11. The following are considered as critical elements of an object (territory):

a) zones, structural and technological elements of the object (territory), including buildings, engineering structures and communications;

b) elements of systems, units of equipment or devices of potentially hazardous installations at the facility (territory);

c) places of use or storage of hazardous substances and materials at the facility (territory);

d) other systems, elements and communications of the object (territory), the need physical protection identified in the course of their vulnerability analysis.

12. Taking into account the degree of threat of committing a terrorist act and the possible consequences of its commission, the following categories of danger of objects (territories) are established:

a) objects (territories) of the first category of danger:

objects (territories) located on the territory of a constituent entity of the Russian Federation in which more than 3 terrorist acts have been committed (attempted to commit) over the past 12 months;

objects (territories), as a result of a terrorist act, where the predicted number of victims is more than 500 people;

objects (territories), as a result of a terrorist act, on which the predicted amount of material damage and damage to the environment natural environment is more than 50 million rubles;

b) objects (territories) of the second category of danger:

facilities (territories) located on the territory of a constituent entity of the Russian Federation in which less than 3 terrorist acts have been committed (attempted to commit) over the past 12 months;

objects (territories), as a result of a terrorist act, where the predicted number of victims is from 100 to 500 people;

objects (territories), as a result of the commission of a terrorist act, on which the predicted amount of material damage and damage to the environment is from 5 to 50 million rubles;

c) objects (territories) of the third category of danger:

facilities (territories) located on the territory of a constituent entity of the Russian Federation in which no terrorist acts (attempts to commit) have been recorded over the past 12 months;

objects (territories), as a result of a terrorist act, where the predicted number of victims is less than 100 people;

objects (territories), as a result of the commission of a terrorist act, on which the predicted amount of material damage and damage to the environment is less than 5 million rubles.

13. All objects (territories) are assigned a category corresponding to the highest quantitative indicator of any of the categorization criteria specified in paragraph 12 of these requirements.

14. The results of the work of the commission are documented by an act of survey and categorization of the object (territory), which is signed by all members of the commission and approved by the chairman of the commission no later than last day commission work.

In case of disagreement between the members of the commission during the preparation of the said act, the decision is taken in the form of voting by a simple majority of votes. In case of equality of votes, the decision is made by the chairman of the commission. Members of the committee who disagree decision, sign the act of inspection and categorization of the object (territory), while their dissenting opinion is attached to the act of inspection and categorization of the object (territory).

15. With regard to each object (territory), in accordance with the act of its inspection and categorization by an official directly managing the activities of employees at the object (territory), taking into account the degree of potential danger and the threat of terrorist acts, as well as the projected amount of expenses for the implementation of relevant measures and sources of financing, a list of measures to ensure the anti-terrorist protection of the facility (territory) is determined.

The deadline for completion of these activities, taking into account the volume of planned work, should not exceed 12 months from the date of approval of the act of survey and categorization of the object (territory).

16. The information contained in the act of inspection and categorization of the object (territory), as well as in the list of measures to ensure the anti-terrorist protection of the object (territory), is information of limited distribution and is subject to protection in accordance with the legislation of the Russian Federation.

Categorization of objects of transport infrastructure. Validity period, frequency

If one or another criterion is changed, the category assigned to the transport infrastructure object/vehicle can be changed. The competent authority informs the subject of the transport infrastructure about the change in the category within a period not exceeding 15 working days from the date of assignment or change of the previously assigned category.

Punishment, fines for non-compliance with transport security requirements

The lack of documentation of the transport security of the facility indicates a failure to fulfill the obligations stipulated by law, which entails liability under Art. 11.15.1:

  • Failure to comply with the requirements for ensuring transport security or failure to comply with the requirements for observing transport security, committed through negligence, if these actions (inaction) do not contain a criminally punishable act, - entails the imposition administrative fine for citizens in the amount of three thousand to five thousand rubles; on officials - from twenty thousand to thirty thousand rubles; on the individual entrepreneurs- from thirty thousand to fifty thousand rubles; on the legal entities- from fifty thousand to one hundred thousand rubles.
  • Repeated commission administrative offense, - shall entail the imposition of an administrative fine on citizens in the amount of five thousand to ten thousand roubles; on officials - from thirty thousand to fifty thousand rubles; for individual entrepreneurs - from fifty thousand to seventy thousand rubles or an administrative suspension of activities for a period of up to ninety days; for legal entities - from one hundred thousand to two hundred thousand rubles or an administrative suspension of activities for a period of up to ninety days.

Criteria for categorizing objects of transport infrastructure and vehicles

Transport infrastructure facilities and vehicles are subject to mandatory categorization.
The main criteria for categorizing transport infrastructure facilities (OTI) / vehicles (TC) are:

  • the degree of threat of an act of unlawful interference in the activities of transport infrastructure / vehicles, which is determined on the basis of quantitative indicators of statistical data on committed and prevented acts of unlawful interference on the territory of the Russian Federation for the last 12 months prior to categorization.
  • possible consequences of the commission of an act of unlawful interference in the activities of transport infrastructure / vehicles, which are determined on the basis of quantitative indicators of possible dead or injured people, and possible material damage.

For transport infrastructure facilities, 5 (five) categories are established, for vehicles 4 (four) categories. For each mode of transport, the Ministry of Transport of the Russian Federation has defined a list of transport infrastructure facilities and vehicles that are not subject to categorization.

Up to 4 categories of transport infrastructure facilities and vehicles are established in descending order of their importance: first, second, third, fourth.

We are talking about road, air, urban land electric, rail, sea and river transport, metro and road facilities.

The criterion for referring to one or another category is the degree of threat of an act of unlawful interference (hereinafter - UA). It is determined on the basis of statistical data on the number of AIAs that occurred and averted in Russia a year before categorization. Also, these are the expected consequences of committing ANV. They are calculated on the basis of the number of possible dead or injured people, damage to the environment and material.

The competent authority in the field of ensuring transport security must inform the subject of the transport infrastructure about the assignment or change of the previously established category. Deadline - up to 15 working days.

This Order shall enter into force 10 days after the date of its official publication.

According to the Federal Law "On Transport Security", transport infrastructure entities are required to provide the competent authorities in the field of transport security with complete and reliable information for the categorization of OTI and TS.
Depending on the type of transport, the relevant documents are submitted to Rosavtodor, Roszheldor, Rosmorrechflot or Rosaviatsiya.

In the course of categorization, an object of transport infrastructure or a vehicle is assigned to one of the categories.
For OTI, no more than 5 (five) categories are established, for vehicles there are 4 categories. The highest is first, the rest are sorted in descending order.

The higher the category assigned to a transport infrastructure object or vehicle, the higher the requirements for ensuring its transport security.

There are several criteria for categorizing objects and vehicles:

  • The degree of threat of an act of unlawful interference.
    It is determined on the basis of statistics on committed and prevented AIAs in the territory of the Russian Federation, including in relation to categorized ATIs and TSs for the period of the last 12 months prior to the categorization.
  • Possible consequences of an act of unlawful interference based on the number of victims and victims
  • Possible consequences of an act of unlawful interference based on material damage

Application

1. The procedure for establishing the number of categories and criteria for categorizing transport infrastructure facilities and vehicles (hereinafter referred to as the Procedure) was developed in accordance with paragraph 1 of Article 6 of the Federal Law "On Transport Security" (Collected Legislation of the Russian Federation, 2007, No. 7 (part I) , Art. 837; 2008, N 30 (part II), Art. 3616; 2009, N 29, Art. 3634).

2. The main objectives of categorization is the assignment by the competent authority in the field of ensuring transport security of each object of transport infrastructure (hereinafter - TTI) and / or vehicle (hereinafter - TS) to one of the categories.

3. No more than five categories of transport infrastructure facilities and four categories of vehicles of automobile, air, urban ground electric, rail, sea and river transport, subway and transport infrastructure facilities of the road economy are established in descending order of their importance - first, second, third, fourth , fifth.

5.1. 5.2. Possible consequences of the commission of an act of unlawful interference in the activities of transport infrastructure facilities and / or vehicles in relation to certain modes of transport, which are determined on the basis of quantitative indicators of possible dead or injured people, and possible material damage.

6. Based on the results of the categorization of the PTI and / or the TS, a category is assigned that corresponds to the highest quantitative indicator of any of the categorization criteria, in accordance with Annexes No. 1-6 to the Procedure.

7. In the event of a change in the highest (highest) quantitative indicators of the categorization criteria, the value of the category assigned by the GTI or TS changes.

8. The competent authority in the field of ensuring transport security informs the subject of the transport infrastructure about the assignment or change of the previously assigned category of OTI and / or TS within a period not exceeding 15 working days from the date of assignment or change of the previously assigned category.

9. Categorized objects of transport infrastructure and/or vehicles are included in the register of categorized objects of transport infrastructure and/or vehicles, which is maintained by the competent authority in the field of ensuring transport security on electronic and paper media.
