REGULATIONS ON THE MINISTRY OF EDUCATION AND SCIENCE OF THE RUSSIAN FEDERATION

I. General provisions

1. The Ministry of Education and Science of the Russian Federation (Ministry of Education and Science of Russia) is a federal body executive power executing the functions of developing and implementing state policy and legal regulation in the field of education, scientific, scientific and technical and innovation activities, nanotechnologies, development of federal centers of science and high technologies, state scientific centers and science cities, intellectual property (with the exception of regulatory legal regulation issues related to control, supervision and provision of public services in the field of legal protection inventions utility models, industrial designs, programs for electronic computers, databases and topologies integrated circuits, including those included in the unified technology, trademarks, service marks, appellations of origin of goods), in the field of education, guardianship and guardianship of minors, social support and social protection students of educational organizations, in the field of youth policy, as well as the functions of providing public services and managing state property in the field of education, upbringing, scientific, scientific, technical and innovative activities, including the activities of federal centers of science and high technologies, state scientific centers, unique scientific stands and installations, federal centers for collective use, leading scientific schools, a new generation national research computer network and information support for scientific, scientific, technical and innovative activities.

2. The Ministry of Education and Science of the Russian Federation coordinates and controls the activities of the Federal Service for Supervision of Education and Science and the Federal Agency for Youth Affairs, which are under its jurisdiction.

3. The Ministry of Education and Science of the Russian Federation is guided in its activities by the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties Russian Federation, as well as these Regulations.

4. The Ministry of Education and Science of the Russian Federation carries out its activities directly and through organizations subordinate to it in cooperation with other federal executive authorities, executive authorities of the constituent entities of the Russian Federation, bodies local government, public associations and other organizations.

II. Powers

5. The Ministry of Education and Science of the Russian Federation shall exercise the following powers:

5.1. submits to the Government of the Russian Federation draft federal laws, regulatory legal acts of the President of the Russian Federation and the Government of the Russian Federation and other documents requiring a decision of the Government of the Russian Federation, on issues related to the established area of responsibility of the Ministry and to the area of jurisdiction of subordinated to it federal service and federal agency, to the activities of the Higher attestation commission under the Ministry of Education and Science of the Russian Federation, as well as a draft work plan and forecast indicators for the activities of the Ministry;

5.2. on the basis of and in pursuance of the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation independently adopts the following regulatory legal acts:

5.2.1. lists of professions, specialties and areas of training indicating the qualifications assigned to the relevant professions, specialties and areas of training, the procedure for the formation of these lists;

5.2.2. a list of professions of workers, positions of employees for which vocational training is carried out, indicating the qualifications assigned for the corresponding professions of workers, positions of employees;

5.2.3. on the correspondence of individual professions, specialties and areas of training indicated in the new lists of professions, specialties and areas of training, professions, specialties and areas of training indicated in the previous lists of professions, specialties and areas of training;

5.2.4. a list of professions, specialties and areas of training, the implementation of educational programs for which is not allowed using exclusively e-learning, distance learning technologies;

5.2.5. the procedure for the use by organizations engaged in educational activities, e-learning, distance learning technologies in the implementation of educational programs;

5.2.6. organization and implementation educational activities on relevant educational programs different levels and (or) orientations or according to the corresponding type of education;

5.2.7. the procedure for developing exemplary basic educational programs, conducting their examination and maintaining a register of exemplary basic educational programs, features of developing, conducting an examination and including in such a register of exemplary basic professional educational programs containing information constituting state secret, and exemplary basic professional educational programs in the field information security;

5.2.8. regulations on the practice of students mastering the main professional educational programs, and its types;

5.2.9. the procedure for the formation of a federal list of textbooks recommended for use in the implementation of state-accredited educational programs of primary general, basic general, secondary general education, including the criteria and procedure for the examination of textbooks, form expert opinion, as well as the grounds and procedure for exclusion of textbooks from the specified federal list;

5.2.10. procedure for selecting organizations issuing teaching aids, which are allowed to be used in the implementation of state-accredited educational programs of primary general, basic general, secondary general education, and a list of such organizations;

5.2.11. model provisions on educational and methodological associations in the education system;

5.2.12. the procedure for the formation and functioning of the innovation infrastructure in the education system (including the procedure for recognizing an organization as a federal innovation platform), a list of federal innovation platforms;

5.2.13. a list of indicators, criteria and frequency for evaluating the effectiveness of the implementation of development programs for national research universities;

5.2.14. the procedure for creating professional educational organizations and educational organizations higher education departments and other structural units that provide practical training for students on the basis of other organizations that carry out activities in the profile of the relevant educational program;

5.2.15. performance indicators of an educational organization subject to self-examination, and the procedure for its conduct;

5.2.16. samples of student card and record book;

5.2.17. the procedure and grounds for granting academic leave to students;

5.2.18. cases and procedure for the transition of students from paid education to free education;

5.2.19. the procedure for transferring a student to another educational organization that implements an educational program of the appropriate level;

5.2.20. the procedure and conditions for the transfer of students in the event of termination of the activities of an organization engaged in educational activities, cancellation of the relevant license, deprivation of its state accreditation for the relevant educational program or expiration of the state accreditation for the relevant educational program to other organizations engaged in educational activities for educational programs of the appropriate level and direction;

5.2.21. the procedure and conditions for the transfer of students in the event of suspension of a license, suspension of state accreditation in full or in relation to individual levels of education, enlarged groups of professions, specialties and areas of training to other organizations engaged in educational activities on state-accredited basic educational programs of the appropriate level and focus ;

5.2.22. the procedure for assigning state academic scholarships and (or) state social scholarships to students studying full-time at the expense of budgetary appropriations federal budget, as well as the requirements for students studying full-time at the expense of the budgetary allocations of the federal budget, who are assigned a state academic scholarship;

5.2.23. the procedure for assigning state scholarships to graduate students, residents, assistant trainees studying full-time at the expense of the budgetary allocations of the federal budget;

5.2.24. the procedure for paying scholarships to students of preparatory departments of federal state educational organizations of higher education who study at the expense of budget allocations from the federal budget;

5.2.25. the procedure for applying to students and removing from students disciplinary measures;

5.2.26. the procedure for granting teaching staff long-term leave for up to one year;

5.2.27. features of the regime of working time and rest time of pedagogical workers of organizations engaged in educational activities;

5.2.28. the procedure for attestation of teaching staff of organizations engaged in educational activities (in agreement with the Ministry of Labor and Social Protection of the Russian Federation);

5.2.29. exemplary forms of agreements on education;

5.2.30. the procedure for admission to study in educational programs of each level of education (including the procedure for admission foreign citizens and stateless persons, the maximum number of educational institutions of higher education, in which an applicant for undergraduate or specialist degree programs is entitled to apply simultaneously, and the number of specialties and areas of training in which he is entitled to participate in the competition);

5.2.31. features of conducting entrance examinations for persons with disabilities;

5.2.33. a list of entrance examinations for admission to training in the main professional educational programs of each level;

5.2.34. a list of additional entrance tests for admission to higher education programs;

5.2.35. forms of state final certification;

5.2.36. the procedure for conducting the state final attestation for relevant educational programs of various levels and in any form (including the requirements for the use of training and education tools, communication facilities during the state final attestation, the requirements for persons involved in the state final attestation, the procedure for submitting and considering appeals, changes and (or) cancellation of the results of the state final certification);

5.2.37. forms of state final certification for students in educational programs of secondary general education in special educational institutions of a closed type, as well as in institutions executing punishment in the form of deprivation of liberty, for students receiving secondary general education as part of the development of secondary educational programs vocational education, including educational programs of secondary vocational education, integrated with the main educational programs of basic general and secondary general education, for students with disabilities or for students with disabilities and disabled children in educational programs of secondary general education;

5.2.38. procedure for accreditation of citizens as public observers;

5.2.39. samples of documents on education, documents on education and qualifications (with the exception of samples of diplomas on completion of residency or assistantship-internship) and annexes to them, a description of these documents and applications, the procedure for filling out, recording and issuing these documents and their duplicates;

5.2.40. a sample certificate of training and the procedure for issuing it to persons with disabilities (with various forms mental retardation), who do not have basic general and secondary general education and studied according to adapted basic general education programs;

5.2.41. federal state educational standards;

5.2.42. federal state educational standards for residency programs (in agreement with the Ministry of Health of the Russian Federation);

5.2.43. federal state educational standards for assistantship-internship programs (in agreement with the Ministry of Culture of the Russian Federation);

5.2.44. federal state educational standards for educational programs of secondary vocational education and higher education in the field of training aviation personnel civil aviation, ship crew members in accordance with international requirements, as well as in the field of training of railway workers directly related to the movement of trains and shunting work (in agreement with the Ministry of Transport of the Russian Federation);

5.2.45. the procedure for the formation of national teams of the Russian Federation for participation in international olympiads in general education subjects;

5.2.46. the procedure for selecting federal state educational organizations of higher education, in the preparatory departments of which training is carried out at the expense of the budgetary allocations of the federal budget, and a list of these organizations;

5.2.47. the procedure for holding Olympiads for schoolchildren (including the establishment of a list and levels of Olympiads for schoolchildren, including the criteria for determining the levels of these Olympiads, samples of diplomas of winners and prize-winners of schoolchildren's Olympiads, the procedure for granting special rights to winners and prize-winners of schoolchildren's Olympiads when admitted to educational organizations of higher education for study programs undergraduate and specialist degree programs in specialties and (or) areas of training corresponding to the profile of the Olympiad for schoolchildren);

5.2.48. procedure and timing All-Russian Olympiad schoolchildren, including a list of general education subjects in which it is held, the final results of its implementation, samples of diplomas of winners and prize-winners of the All-Russian Olympiad for schoolchildren;

5.2.49. the procedure for creating in educational organizations implementing educational programs of higher education, scientific organizations and other organizations engaged in scientific (research) activities, laboratories engaged in scientific (research) and (or) scientific and technical activities;

5.2.50. the procedure for the creation by educational organizations implementing educational programs of higher education, in scientific organizations and other organizations carrying out scientific (research) activities, departments carrying out educational activities;

5.2.51. the procedure for developing additional professional programs containing information constituting a state secret, and additional professional programs in the field of information security (in agreement with the Federal Security Service of the Russian Federation and the Federal Service for Technical and Export Control);

5.2.52. the procedure for selecting foreign citizens for training within the quota established by the Government of the Russian Federation, as well as the requirements for them;

5.2.53. the procedure and criteria for the selection of federal state educational organizations, at the preparatory departments and preparatory faculties of which foreign citizens who enter within the quota established by the Government of the Russian Federation are entitled to study under additional general educational programs that provide training for foreign citizens to master professional educational programs in Russian for account of budget appropriations of the federal budget, and a list of these educational organizations;

5.2.54. the procedure for investigating and recording accidents with students during their stay in an organization carrying out educational activities (as agreed with the Ministry of Health of the Russian Federation);

5.2.55. requirements for the development of additional general education programs that provide training for foreign citizens to master professional educational programs in Russian;

5.2.56. features of the organization of educational activities for students with disabilities (together with the Ministry of Labor and Social Protection of the Russian Federation);

5.2.57. the procedure for organizing and carrying out educational activities in educational institutions with special names " cadet school"," Cadet (Naval Cadet) Military Corps "and" Cossack Cadet Corps ";

5.2.58. the form of a license to carry out educational activities, the form of an annex to the license and technical requirements to the specified documents;

5.2.59. application forms for state accreditation and documents attached to it, as well as requirements for their completion and execution;

5.2.60. qualification requirements to experts, requirements for expert organizations, the procedure for attracting, selecting experts and expert organizations for accreditation examination, the procedure for their accreditation (including the procedure for maintaining a register of experts and expert organizations);

5.2.61. forms of a certificate of state accreditation of educational activities and annexes to it, as well as technical requirements for these documents;

5.2.62. list of documents attached to the application for recognition foreign education and (or) foreign qualifications, the procedure and terms for conducting an examination of a foreign education and (or) foreign qualifications, as well as the form of a certificate of recognition of a foreign education and (or) foreign qualifications and technical requirements for it;

5.2.63. the procedure for carrying out the activities of school sports clubs and student sports clubs (including in the form of public associations) that are not legal entities;

5.2.64. on the procedure for filling positions of scientific and pedagogical workers;

5.2.65. on the procedure for attestation of employees holding positions of scientific and pedagogical workers;

5.2.66. the procedure and terms for attestation of candidates for the position of head and head of an educational organization subordinate to the Ministry;

5.2.67. regulations on the psychological, medical and pedagogical commission and the procedure for conducting a comprehensive psychological, medical and pedagogical examination of children (in agreement with the Ministry of Health of the Russian Federation);

5.2.68. the procedure for maintaining a state data bank on children left without parental care, and exercising control over its formation and use;

5.2.69. about legal framework assessment of the qualifications of specialists of a scientific organization and the criteria for this assessment;

5.2.70. on the legal basis for assessing the qualifications of scientific workers of a scientific organization and the criteria for this assessment;

5.2.71. on the length of working hours (norms of hours of pedagogical work for the rate wages);

5.2.72. procedure for recognition of documents foreign states on academic degrees and academic titles on the territory of the Russian Federation and the issuance of relevant certificates;

5.2.73. forms of certificates of recognition of documents of foreign states on academic degrees and academic titles on the territory of the Russian Federation, technical requirements for them;

5.2.74. normative legal acts on issues of the established sphere of activity of the Ministry and subordinate to the Ministry of the Federal Service and the federal agency, with the exception of issues whose legal regulation in accordance with the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation is carried out exclusively by federal constitutional laws, federal laws, regulatory legal acts the President of the Russian Federation and the Government of the Russian Federation;

5.3. in accordance with the procedure established by the legislation of the Russian Federation, places orders and concludes government contracts, as well as other civil law contracts for the supply of goods, performance of work, provision of services to meet the needs of the Ministry, as well as for the conduct of research, development and technological work for other state needs in the established field of activity;

5.4. summarizes the practice of applying the legislation of the Russian Federation, analyzes the implementation of state policy and prepares proposals for improving the legislation of the Russian Federation in the established field of activity;

5.4.1. develops and implements measures to promote competition in commodity markets, including the implementation of relevant departmental targeted programs, in the established field of activity;

5.5. carries out:

5.5.1. in the manner and within the limits determined by federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, the powers of the owner in relation to federal property necessary to ensure the performance of the functions of federal bodies state power in the field of activity established by paragraph 1 of this Regulation, including property transferred to federal state organizations, federal state unitary enterprises and state-owned enterprises subordinate to the Ministry;

5.5.2. the powers and functions of the founder in relation to subordinate organizations;

5.5.3. functions of the main manager and recipient of federal budget funds provided for the maintenance of the Ministry and the implementation of the functions assigned to it;

5.5.4. functions state customer federal targeted programs and projects in the established field of activity;

5.5.5. formation of instrumental, technological and information base for the development of the nanoindustry;

5.5.6. monitoring of scientific, technical and production potential in the field of nanotechnology;

5.5.7. setting target enrollment quotas for higher education in the amount set for the next year of the target figures for the admission of citizens to study at the expense of the budget allocations of the federal budget for each level of higher education, each specialty and each area of training in relation to organizations, the functions and powers of the founder of which are performed by the Ministry;

5.5.8. establishment of organizations that are granted the right to maintain a register of exemplary basic educational programs;

5.5.9. organizational and technical support for the activities of the Higher Attestation Commission under the Ministry of Education and Science of the Russian Federation;

5.5.10. extradition in in due course at the request of educational organizations of higher education, educational organizations of additional professional education and scientific organizations, permissions to create on their basis councils for defending dissertations for the degree of candidate of science, for the degree of doctor of science, determining and changing the composition of these councils, determining lists of specialties, on which these councils are granted the right to accept dissertations for defense;

5.5.11. recognition of documents of foreign states on academic degrees and academic titles on the territory of the Russian Federation, issuance of certificates of recognition of documents of foreign states on academic degrees and academic titles on the territory of the Russian Federation;

5.5.12. coordination in accordance with their powers of the fundamental scientific research carried out at the expense of the federal budget;

5.5.13. coordination of activities in the field of education of federal government agencies, executive authorities of the subjects of the Russian Federation and other subjects of the education system;

5.5.14. organizing monitoring of the education system;

5.5.15. ensuring the implementation of monitoring in the education system at the federal level;

5.5.16. organizing a pedagogical examination of draft normative legal acts and normative legal acts relating to the issues of education and upbringing;

5.6. organizes the reception of citizens, ensures timely and complete consideration of oral and written requests citizens, making decisions on them and sending responses within the period established by the legislation of the Russian Federation;

5.7. ensures, within its competence, the protection of information constituting a state secret;

5.8. ensures mobilization training of the Ministry, as well as control and coordination of the activities of the federal service under its jurisdiction and the federal agency for their mobilization training;

5.9. organizes and manages civil defense in the Ministry;

5.10. organizes additional professional education for federal state civil servants of the Ministry;

5.11. interacts in accordance with the established procedure with public authorities of foreign states and international organizations in the established field of activity;

5.12. carries out, in accordance with the legislation of the Russian Federation, work on the acquisition, storage, accounting and use archival documents formed in the course of the activities of the Ministry;

5.13. coordinates the appointment to the position of the heads of the executive authorities of the constituent entity of the Russian Federation exercising the powers of the Russian Federation in the field of education, transferred for implementation to the state authorities of the constituent entities of the Russian Federation;

5.14. coordinates the creation and liquidation of branches of federal state educational organizations of higher education, in respect of which the Ministry does not exercise the functions and powers of the founder;

5.15. develops and implements measures to support small and medium-sized businesses aimed at their development, including the development and implementation of relevant departmental targeted programs in the established field of activity;

5.16. carries out the development of methodological materials on the activities of guardianship and guardianship in relation to minor citizens;

5.17. submits to the Government of the Russian Federation, on the proposal of the federal executive body exercising the functions of control and supervision in the field of education, proposals on the withdrawal of the powers of the Russian Federation in the field of education, transferred for exercise by the state authorities of the constituent entities of the Russian Federation, from the state authorities of the constituent entities of the Russian Federation;

5.18. develops forecasts for personnel training, requirements for personnel training based on the forecast of labor market needs;

5.19. issues permits to foreign and Russian applicants to conduct marine scientific research in the internal sea waters and territorial sea of the Russian Federation, in its exclusive economic zone and on its continental shelf in agreement with the federal executive authorities determined respectively by the President of the Russian Federation and the Government of the Russian Federation;

5.20. provides support to socially oriented non-profit organizations that carry out, in accordance with founding documents activities in the field of education and science, forms and leads federal register socially oriented non-profit organizations- beneficiaries of such support;

5.21. provides organizational and methodological support and coordination of activities for the prevention of neglect and juvenile delinquency, carried out by social institutions, clubs and other institutions under the jurisdiction of the Ministry;

5.22. creates in collaboration with public organizations and movements representing the interests of youth, the conditions for ensuring healthy lifestyle life, moral and patriotic education of youth, realization of professional opportunities of youth;

5.23. provides assistance to children's and youth public associations, social institutions, funds and other institutions and organizations whose activities are related to the implementation of measures to prevent neglect and juvenile delinquency;

5.24. carries out in accordance with the established procedure on behalf of the Russian Federation the disposal of the rights to intellectual property objects and other scientific and technical results created at the expense of the federal budget by order of the Ministry;

5.25. carries out an economic analysis of the activities of subordinate state unitary enterprises and approves the economic indicators of their activities, conducts audits of financial and economic activity and use of the property complex;

5.26. organizes congresses, conferences, olympiads, seminars, exhibitions and other events in the established field of activity;

5.27. performs other functions in the established field of activity, including the management of state property and the provision of public services, if such functions are provided for by federal laws, regulatory legal acts of the President of the Russian Federation or the Government of the Russian Federation.

6. The Ministry of Education and Science of the Russian Federation, in order to exercise powers in the established field of activity, has the right:

6.1. to request and receive in accordance with the established procedure the information necessary for making decisions on issues within the competence of the Ministry;

6.2. involve in the prescribed manner for the study of issues related to the field of activity of the Ministry, scientific and other organizations, scientists and specialists;

6.3. create coordinating, advisory and expert bodies (councils, commissions, groups, colleges), including interdepartmental ones, in the established field of activity;

6.4. establish printed media in the prescribed manner mass media for the publication of regulatory legal acts in the established field of activity, official announcements, placement of other materials on issues within the competence of the Ministry and subordinate to the federal service and the federal agency;

6.5. provide legal and individuals on issues related to the sphere of activity of the Ministry;

6.6. adopt regulatory legal acts on the implementation by state authorities of the constituent entities of the Russian Federation of delegated powers in the field of education, including administrative regulations provision of public services and execution state functions in the field of transferred powers in the field of education, and also has the right to set target forecast indicators for the implementation by the subjects of the Russian Federation of the transferred powers in the field of education;

6.7. establish, in agreement with the Heraldic Council under the President of the Russian Federation, a heraldic sign - an emblem, flag and pennant of the federal service and federal agency under the jurisdiction of the Ministry;

6.8. establish nominal scholarships, determine the amount and conditions of their payment.

The restrictions on the powers of the Ministry established by the first paragraph of this clause do not apply to the powers of the Minister to resolve personnel issues and issues of organizing the activities of the Ministry and its structural divisions.

When exercising legal regulation in the established field of activity, the Ministry is not entitled to establish the functions and powers of federal state authorities, state authorities of the constituent entities of the Russian Federation, local self-government bodies that are not provided for by federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, as well as restrictions on the exercise of the rights and freedoms of citizens, the rights of non-state commercial and non-profit organizations, with the exception of cases where the possibility of imposing such restrictions by acts of authorized federal executive bodies is directly provided for by the Constitution of the Russian Federation, federal constitutional laws, federal laws and issued on the basis of and pursuant to the Constitution of the Russian Federation, federal constitutional laws, federal laws acts of the President of the Russian Federation and the Government of Ro Russian Federation.

III. Organization of activities

The Minister is personally responsible for the fulfillment of the powers assigned to the Ministry of Education and Science of the Russian Federation and the implementation of state policy in the established field of activity.

The Minister has deputies who are appointed and dismissed by the Government of the Russian Federation.

The number of Deputy Ministers is established by the Government of the Russian Federation.

9. Structural subdivisions of the Ministry of Education and Science of the Russian Federation are departments in the main areas of activity of the Ministry. Departments are made up of divisions.

10. Minister:

10.1. distributes duties among his deputies;

10.2. approves the provisions on structural divisions ministries;

10.3. appoints and dismisses employees of the Ministry in accordance with the established procedure;

10.4. decides, in accordance with the legislation of the Russian Federation on public service, issues related to the passage of the federal public service in the Ministry;

10.5. approves the structure and staffing of the central office of the Ministry within the limits of the payroll fund and the number of employees established by the Government of the Russian Federation, the cost estimate for its maintenance within the limits approved for the corresponding period of appropriations provided for in the federal budget;

10.6. approves the annual work plan and performance indicators of the federal service and federal agency subordinate to the Ministry, as well as reports on their activities;

10.7. submits to the Government of the Russian Federation, on the proposal of the heads of the federal service and the federal agency subordinate to the Ministry of the Federal Service and the federal agency, draft regulations on the federal service and the federal agency, as well as proposals on the maximum number of employees of the federal service and the federal agency and the payroll fund for their employees;

10.8. submits to the Government of the Russian Federation, in accordance with the established procedure, proposals on the creation, reorganization and liquidation of federal government organizations that are under the jurisdiction of the Ministry and subordinate to the Ministry of the federal service and the federal agency;

10.9. submits to the Government of the Russian Federation drafts of normative legal acts, other documents specified in subparagraph 5.1 of these Regulations;

10.10. gives the heads of the subordinate to the Ministry of the Federal Service and the federal agency binding instructions;

10.11. suspends, if necessary, decisions of the federal service and federal agency subordinate to the Ministry (their heads) or cancels these decisions, unless a different procedure for their cancellation is established by federal laws;

10.12. appoints and dismisses from office on the proposal of the heads of the subordinate to the Ministry of the Federal Service and the federal agency the deputy heads of the federal service and the federal agency;

10.13. submits, in accordance with the established procedure, employees of the Ministry and subordinate to the Ministry of the federal service and federal agency, other persons carrying out activities in the established field, for the assignment of honorary titles and the awarding of state awards of the Russian Federation, Honorary diploma the President of the Russian Federation, by the Certificate of Honor of the Government of the Russian Federation, to encouragement in the form of declaring gratitude to them from the President of the Russian Federation and the Government of the Russian Federation;

10.14. appoints and dismisses heads of subordinate organizations in accordance with the established procedure, concludes, amends and terminates labor contracts with these heads;

10.15. establishes and assigns departmental awards and titles to employees of the education system;

10.16. issues orders of a normative nature, and on operational and other current issues of organizing the activities of the Ministry - orders of a non-normative nature.

11. Financing of expenses for the maintenance of the Ministry of Education and Science of the Russian Federation is carried out at the expense of funds provided for in the federal budget.

12. The Ministry of Education and Science of the Russian Federation is legal entity, has a seal depicting the State Emblem of the Russian Federation and with its name, other seals, stamps and forms of the established form, accounts opened in accordance with the legislation of the Russian Federation.

The Ministry of Education and Science of the Russian Federation has the right to have a heraldic sign - an emblem, a flag and a pennant, established by the Ministry in agreement with the Heraldic Council under the President of the Russian Federation.

2. Establish that the Ministry of Education and Science of the Russian Federation ensures the implementation of the powers defined in accordance with this resolution, within the limits of the maximum number of employees of the Ministry established by the Government of the Russian Federation, as well as budget allocations provided for the Ministry in the federal budget for leadership and management in the area of established functions.

3. Recognize as invalid the acts of the Government of the Russian Federation according to the list according to the appendix.

I. General provisions

1. The Ministry of Education and Science of the Russian Federation (Ministry of Education and Science of Russia) is a federal executive body responsible for the development and implementation of state policy and legal regulation in the field of education, scientific, scientific, technical and innovative activities, nanotechnology, development of federal centers of science and high technologies, state scientific centers and science cities, intellectual property (with the exception of the legal regulation of issues related to control, supervision and provision of public services in the field of legal protection of inventions, utility models, industrial designs, programs for electronic computers, databases and topologies of integrated circuits, including those included in the unified technology, trademarks, service marks, appellations of origin of goods), in the field of education, guardianship and guardianship of minors, social support and social protection of students of educational organizations, in the field of youth policy, as well as the functions of providing public services and managing state property in the field of education, upbringing, scientific, scientific, technical and innovative activities, including the activities of federal centers of science and high technologies, state scientific centers, unique scientific stands and installations, federal centers for collective use, leading scientific schools, a new generation national research computer network and information support for scientific, scientific, technical and innovative activities.

3. The Ministry of Education and Science of the Russian Federation is guided in its activities by federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties of the Russian Federation, as well as these Regulations.

4. The Ministry of Education and Science of the Russian Federation carries out its activities directly and through organizations subordinate to it in cooperation with other federal executive authorities, executive authorities of the constituent entities of the Russian Federation, local governments, public associations and other organizations.

II. Powers

5. The Ministry of Education and Science of the Russian Federation shall exercise the following powers:

5.1. submits to the Government of the Russian Federation draft federal laws, regulatory legal acts of the President of the Russian Federation and the Government of the Russian Federation and other documents that require a decision of the Government of the Russian Federation on issues related to the established area of responsibility of the Ministry and to the area of responsibility of the federal service subordinate to it and the federal agencies, to the activities of the Higher Attestation Commission under the Ministry of Education and Science of the Russian Federation, as well as the draft work plan and forecast indicators of the Ministry's activities;

5.2. on the basis of and in pursuance of federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation independently adopts the following regulatory legal acts:

5.2.4. a list of professions, specialties and areas of training, the implementation of educational programs for which is not allowed using exclusively e-learning, distance learning technologies; *5.2.4)

5.2.5. the procedure for the use by organizations engaged in educational activities, e-learning, distance learning technologies in the implementation of educational programs;

5.2.6. the procedure for organizing and carrying out educational activities for the relevant educational programs of various levels and (or) directions or for the corresponding type of education; *5.2.6)

5.2.7. the procedure for developing exemplary basic educational programs, conducting their examination and maintaining a register of exemplary basic educational programs, features of the development, examination and inclusion in such a register of exemplary basic professional educational programs containing information constituting a state secret, and exemplary basic professional educational programs in the field of information security; *5.2.7)

5.2.8. regulations on the practice of students mastering the main professional educational programs, and its types;

5.2.9. the procedure for the formation of a federal list of textbooks recommended for use in the implementation of state-accredited educational programs of primary general, basic general, secondary general education, including the criteria and procedure for the examination of textbooks, the form of an expert opinion, as well as the grounds and procedure for excluding textbooks from the specified federal list; *5.2.9)

5.2.10. the procedure for selecting organizations that produce textbooks that are allowed to be used in the implementation of state-accredited educational programs of primary general, basic general, secondary general education, and a list of such organizations;

5.2.11. standard provisions on educational and methodological associations in the education system; *5.2.11)

5.2.13. a list of indicators, criteria and frequency for evaluating the effectiveness of the implementation of development programs for national research universities;

5.2.14. the procedure for the creation by professional educational organizations and educational organizations of higher education of departments and other structural units that provide practical training for students on the basis of other organizations operating in the profile of the relevant educational program;

5.2.15. performance indicators of an educational organization subject to self-examination, and the procedure for its conduct;

5.2.16. samples of student card and record book;

5.2.17. the procedure and grounds for granting academic leave to students;

5.2.18. cases and procedure for the transition of students from paid education to free education;

5.2.19. the procedure for transferring a student to another educational organization that implements an educational program of the appropriate level; *5.2.19)

5.2.22. the procedure for assigning a state academic scholarship and (or) a state social scholarship to students studying full-time at the expense of the federal budget, as well as requirements for students studying full-time at the expense of the federal budget, who are assigned a state academic scholarship; *5.2.22)

5.2.23. the procedure for assigning state scholarships to graduate students, residents, assistant trainees studying full-time at the expense of the budgetary allocations of the federal budget; *5.22.23)

5.2.25. the procedure for applying to students and removing from students disciplinary measures;

5.2.26. the procedure for granting teaching staff long-term leave for up to one year;

5.2.27. features of the regime of working time and rest time of pedagogical workers of organizations engaged in educational activities;

5.2.28. the procedure for attestation of teaching staff of organizations engaged in educational activities (in agreement with the Ministry of Labor and Social Protection of the Russian Federation); *5.2.28)

5.2.31. features of conducting entrance examinations for persons with disabilities;

5.2.38. procedure for accreditation of citizens as public observers;

5.2.40. a sample certificate of education and the procedure for issuing it to persons with disabilities (with various forms of mental retardation), who do not have basic general and secondary general education and who studied according to adapted basic general education programs; *5.2.40)

5.2.42. federal state educational standards for residency programs (in agreement with the Ministry of Health of the Russian Federation);

5.2.43. federal state educational standards for assistantship-internship programs (in agreement with the Ministry of Culture of the Russian Federation);

5.2.44. federal state educational standards for educational programs of secondary vocational education and higher education in the field of training aviation personnel of civil aviation, crew members in accordance with international requirements, as well as in the field of training railway workers directly related to train traffic and shunting work (according to agreement with the Ministry of Transport of the Russian Federation);

5.2.45. the procedure for the formation of national teams of the Russian Federation for participation in international olympiads in general education subjects;

5.2.48. the procedure and terms for holding the All-Russian Olympiad for schoolchildren, including a list of general education subjects in which it is held, the final results of its conduct, samples of diplomas of winners and prize-winners of the All-Russian Olympiad for schoolchildren; *5.2.48)

5.2.52. the procedure for selecting foreign citizens for training within the quota established by the Government of the Russian Federation, as well as the requirements for them; *5.2.52)

5.2.55. requirements for the development of additional general education programs that provide training for foreign citizens to master professional educational programs in Russian;

5.2.56. features of the organization of educational activities for students with disabilities (together with the Ministry of Labor and Social Protection of the Russian Federation);

5.2.57. the procedure for organizing and carrying out educational activities in educational organizations with the special names "cadet school", "cadet (naval cadet) military corps" and "Cossack cadet corps";

5.5.9. organizational and technical support for the activities of the Higher Attestation Commission under the Ministry of Education and Science of the Russian Federation;

5.5.10. issuance, in accordance with the established procedure, at the request of educational organizations of higher education, educational organizations of additional professional education and scientific organizations, permissions to create on their basis councils for the defense of dissertations for the degree of candidate of science, for the degree of doctor of science, determination and change in the composition of these councils, determination of lists of specialties for which these councils are granted the right to accept dissertations for defense;

5.5.11. recognition of academic degrees and academic titles obtained in a foreign state, issuance of a certificate of recognition of an academic degree or academic title obtained in a foreign state, if academic degrees and academic titles obtained in a foreign state do not meet the conditions provided for in paragraph 2 of Article 6_2 of the Federal Law "On Science and State Scientific and Technical Policy";

5.5.15. ensuring the implementation of monitoring in the education system at the federal level;

5.5.17. assignment of academic titles of professor and associate professor;

11. Financing of expenses for the maintenance of the Ministry of Education and Science of the Russian Federation is carried out at the expense of funds provided for in the federal budget.

The Office for Science and Higher Education, together with the Ministry of Education of the Russian Federation, will regulate the procedure for the use of e-learning technologies and distance learning technologies by educational organizations.
